Training Terms and Conditions
These terms govern enrollment in Yacoda's online CasADi training: Online CasADi basic training (OCBT) and Online CasADi advanced training (OCAT), in each of the three tiers Self-study, Guided and Mentored. They supplement the general Terms of Use; where the two conflict, these terms apply to the training. Clauses that hold for one tier only say so.
Parties
The training is provided by Yacoda BV, Glabbeeksestraat 37, 3300 Vissenaken, Belgium (company / VAT number BE 0642.979.742), training@yacoda.com, referred to as Yacoda. The person enrolling is referred to as the participant. Where an employer enrolls on behalf of a named person, the employer owes the enrollment fee and that named person is the participant.
Enrollment rights and obligations
Enrollment entails a right to participate in one cohort of one track, at the tier enrolled in:
- at every tier: access to the pre-recorded seminars, the exercise sheets in the programming language of the participant's choice, the code solutions to all exercises, the pre-recorded exercise solution walkthroughs, and a certificate of completion;
- at the Guided and Mentored tiers, in addition: the six-week learning journey with the cohort, the community forum private to the cohort, two offered timeslots per week for a three-hour live session for exercises and general questions, and the recordings of those live sessions;
- at the Mentored tier, in addition: one-to-one consulting as described below, an optional one-to-one exam, and a certificate of excellence if the exam is taken.
Enrollment entails an obligation to pay the enrollment fee.
Yacoda reserves the right to revoke the right-to-participate if an invoice is not paid in a timely manner (within 30 days) and after an email reminder. Exceptions may be granted via email.
Cohorts and timing
Each enrollment selects a cohort, identified by its start date. The teaching material is released progressively over the six weeks that follow. The learning journey runs for those six weeks.
Live sessions are held at two timeslots per week, one placed to suit European hours and one placed to suit North-American hours. The two cover the same ground and the participant attends whichever suits them. Attendance is not a condition for any certificate.
Live sessions are recorded, and the recording is shared with the participants of that cohort. The recording forms part of the teaching material and is governed by the article Teaching material — in particular, it may not be passed on outside the cohort. A participant who does not wish to appear in a recording may take part with their camera and microphone off; a participant who speaks during a session accepts that their contribution is recorded and shared with the cohort on that basis.
The dates and times of a cohort's live sessions are published before enrollment opens and are shown on the cohort's schedule page, reachable from the course page. A cohort's schedule may in addition carry reserve slots, published alongside the scheduled sessions and marked as such. A reserve slot is held so that a session which has to be moved has somewhere to go; it is not a session of the learning journey, nothing is taught in it unless it is used, and no right arises from one being published.
Duration of access
Access to the teaching material listed above — the live-session recordings included — and to the cohort forum, runs from the cohort start date for one year at the Self-study and Guided tiers, and for two years at the Mentored tier. Yacoda is not obliged to restore or re-share access after that period.
One-to-one consulting (Mentored)
The Mentored tier entitles the participant to eight hours of one-to-one consulting within one year of the cohort start date, on problems of the participant's choice, bookable as up to four calls and subject to the tutor's calendar availability. In place of a call, the participant may direct the corresponding hours to implementation work or study work carried out by Yacoda.
A booked call canceled less than 24 hours in advance, or not attended, counts against the entitlement. Hours not used within the year lapse, and carry no cash value and no right to a refund.
Material the participant brings to a one-to-one call or submits for implementation or study work is treated as confidential, is used only to carry out that work, and is not disclosed to the cohort or to third parties.
Certificates
A certificate of completion states a typical engagement of 24 hours. Entitlement to it requires that the participant has worked through the material.
At the Mentored tier the participant may take a one-hour one-to-one exam, separate from the one-to-one consulting. A certificate of excellence, giving a qualitative description of the participant's performance in that exam, follows from taking it.
Enrollment is personal
One enrollment admits one named person. Login credentials, seminar videos, exercise sheets and solution walkthroughs may not be shared, resold, mirrored or made available to anyone else, including colleagues within the participant's own organization. An organization training several people enrolls each of them.
Yacoda reserves the right to suspend access where credentials are shared, and to require enrollment of the additional persons who obtained access.
Program execution
Yacoda reserves the right to make changes to the course program without prior notice when deemed needed to improve its quality.
Cohort viability
Yacoda reserves the right to postpone a cohort, or to merge it with another cohort of the same track, if too few participants have enrolled. Participants are notified by email.
A cohort may be postponed once in this way without giving rise to a refund, provided the replacement cohort starts within eight weeks of the original start date. Where the postponement is longer than that, or where a cohort is postponed a second time, the participant chooses between the replacement cohort and a full refund of the enrollment fee.
Computer problems
While the software used in the computer exercises has been extensively tested on many system configurations, its correct functioning cannot be guaranteed on any participant's personal computer, and a malfunction does not oblige Yacoda to a fix or compensation.
In case of malfunction, workarounds may be available in the form of collaboration with co-participants, the use of a virtual machine, or the use of an online server.
Experimental extensions
Where experimental commercial CasADi extensions are made available during the access period, participants at the Guided and Mentored tiers reach them at no further cost. Their existence, scope and timing are not guaranteed, they do not form part of the enrollment, and their absence gives no right to a refund or a reduction.
Cohort forum and conduct
The cohort forum is private to the cohort. Code, models and questions posted there are shared in confidence: participants do not republish or forward the contributions of others outside the cohort. Participants post only material they are entitled to disclose.
Participants treat one another and the tutor with respect. Harassment, intimidation, discriminatory or sexual remarks and personal attacks have no place in the forum, in the live sessions, or in contact between participants that arises from the cohort.
Yacoda reserves the right to moderate or remove contributions, and to withdraw forum access from a participant who breaches this article. In the case of harassment, or of another serious or repeated breach, Yacoda reserves the right to revoke the right-to-participate in full, without refund of the enrollment fee and without prejudice to any other remedy.
Price and payment
Prices are shown including VAT. A business established in another EU member state that supplies a valid VAT number is invoiced under the reverse-charge mechanism. Payment is due at enrollment, or, where Yacoda has issued an invoice, within 30 days of its date.
Academic reduction
A reduction is available to participants enrolling in an academic capacity. Yacoda may ask for evidence of that capacity, and reserves the right to invoice the difference where the reduction was obtained without entitlement.
Cancellation by the participant
A participant may cancel an enrollment at any time. What is refunded depends on when the cancellation takes effect, relative to the cohort start date:
- Prior to the cohort start date
- Refund of the full enrollment fee.
- Within 7 days of the cohort start date
- Refund of 80% of the enrollment fee.
- Within 14 days of the cohort start date
- Refund of 60% of the enrollment fee.
- More than 14 days after the cohort start date
- No refund.
These rules apply to every enrollment alike, whether it is made by a private person, a company, a university, or a self-employed participant.
Where an enrollment covers more than one seat, the seats are not priced alike: the first seat is charged at the list price and each further seat at the reduction shown for its position on the training page, and an academic reduction applies in the same proportion. The enrollment fee of a seat is the amount actually charged for that seat once those reductions have been applied, and not the list price. The percentages above apply to the enrollment fee of the seats being cancelled.
Where some but not all of the seats are cancelled, the enrollment fee of the cancelled seats is the difference between what was charged for the enrollment and what that same enrollment would have cost for the seats retained. Because the reductions depend on how many seats are enrolled, the seats retained may carry a smaller reduction than before, and the refund reflects that. By way of illustration: three seats at a list price of 3,000 euro are charged 3,000, 2,400 and 2,250 euro, or 7,650 euro together; cancelling one of them prior to the cohort start date refunds 2,250 euro, leaving 5,400 euro, which is what two seats cost.
Instead of a cancellation and the associated refund, the participant can opt, up to 14 days after the cohort start date, for one of two alternatives:
- Transfer this agreement with Yacoda to another participant.
- Defer the enrollment to a later cohort of the same track.
A cancellation, a transfer or a deferral is notified by email to training@yacoda.com, and takes effect on the date that email is received.
A refund is paid within 14 days of the cancellation taking effect, by the means used for the payment.
Cancellation by Yacoda
In the event of a cancellation of the course, Yacoda shall refund the participant with the full enrollment fee, and shall not be held accountable for other costs incurred by the participant in relation with the course.
Where Yacoda postpones a cohort or merges it with another rather than canceling the course, Cohort viability applies instead, and governs whether the participant may choose a refund over the replacement cohort.
Teaching material
The material shared with participants — seminar recordings, slides, exercise sheets, solution walkthroughs and the recordings of the live sessions — can be used perpetually by the participant for personal use, but its sharing does not transfer copyright to the participant. Article Enrollment is personal governs what may not be done with it. A live-session recording carries the contributions of other participants, so it is shared within the cohort and may not be passed on outside it.
An exception is granted for the code solutions to the exercises. The participant may create derived works from these, in any commercial or non-commercial setting, provided the result does not compete with Yacoda's training activities.
Liability
Yacoda's liability arising from an enrollment is limited to the enrollment fee paid, except where the law does not permit such a limitation, in particular in the case of fraud, intentional fault, or death or personal injury caused by negligence. Yacoda is not liable for the results the participant obtains by applying the material to their own engineering problems.
Force majeure
Yacoda is not in default where illness of the tutor, failure of a third-party platform, or another circumstance beyond its reasonable control prevents a live session from being held.
In such a circumstance Yacoda reserves the right to reschedule the live session unilaterally and at short notice, and the replacement session may fall after the end of the six-week journey — ordinarily into one of the reserve slots published with the cohort's schedule. Participants are notified by email. A session so rescheduled gives no right to a refund or to a reduction of the enrollment fee.
Personal data
Personal data collected in the course of an enrollment is handled as described in the Privacy Policy.
Changes to these terms
The version of these terms that applies to an enrollment is the version in force on the date of that enrollment. Later changes do not affect an enrollment already made.
Legal disputes
This agreement is governed by Belgian law. Only the court of Leuven, Belgium, is amenable to resolve legal disputes of this agreement, without prejudice to the mandatory protection a participant enrolling as a private person enjoys under the law of their country of residence, and to that participant's right to bring proceedings before the courts of their own domicile.
A private person may also address the Belgian Consumer Mediation Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur), Boulevard du Roi Albert II 8, 1000 Brussels — contact@consumerombudsman.be.
Ruled illegality of selected terms shall not invalidate remaining terms in this agreement.
